These conditions define the procedure for ordering, payment, delivery, return and product complaints, copyright protection and general terms of business when purchasing products/services offered on this page www.jelsaresort.hr can be used for your private use without any fees for use, and according to the following conditions and rules.
The seller is FONTANA HOTEL APARTMANI D.O.O., and the buyer is a visitor to these pages who fills out an electronic order and makes payment via debit/credit card or cash on delivery.
Ordering process
The customer orders the accommodation via the electronic offer form.
Any person who electronically confirms at least one accommodation reservation, fills in the requested information and sends a confirmation of the sent offer is considered a customer.
All prices are expressed in euros (EUR), including VAT.
The customer additionally has the option of displaying prices in other currencies (e.g. euros, US dollars).
The reservation of accommodation and food service is ordered electronically when the offer is confirmed. The service is considered confirmed at the moment when the customer confirms the offer and selects and confirms the payment method.
Terms of ordering, reservation and payment
Inquiries and reservations are accepted through the Hotel’s website, by e-mail or in person at the Hotel’s reception. By reserving capacity through the website, the user of the service declares that he accepts these Terms and Conditions in their entirety. When making a reservation, the user of the service is obliged to provide all the requested information. In order for the reservation to be considered valid, the service user pays a deposit or provides a valid debit/credit card number as a reservation guarantee. All reservations via the Internet system are considered valid only after the reservation has been confirmed by the Hotel. The reservation notification/confirmation must be presented to the reception upon arrival at the Hotel. The ordered services of the Hotel are paid online with one of the debit/credit cards: Visa and MasterCard. In addition to online, it is possible to pay for the order in person at the Hotel reception. The final calculation of services is done at the Hotel reception before departure. The confidentiality of your data is protected and ensured by the use of SSL encryption. Online payment pages are secured using the Secure Socket Layer (SSL) protocol with 128-bit data encryption. SSL encryption is a process of encrypting data to prevent unauthorized access during their transmission. This enables safe transfer of information and prevents unauthorized access to data during communication between the user’s computer and the payment service, and vice versa. The payment service and financial institutions exchange data using a virtual private network (VPN), which is protected against unauthorized access. The used payment service is certified according to the PCI DSS Level 1 security standard prescribed by Visa and MasterCard rules. The hotel does not store credit card numbers and the numbers are not accessible to unauthorized persons. The payment service is based on the 3-D Secure standard, which currently offers the most secure payment solution with credit and debit cards in the Internet environment. If the user’s card participates in the 3-D Secure program, the customer will be asked for additional identity verification as confirmation that he is the one using the card. All prices are expressed in euros (EUR), including VAT. The amount for which your debit/credit card will be charged is obtained through price conversion according to the valid exchange rate list. When charging with your debit/credit card, the same amount is converted from Euros to your local currency according to the rules that apply to payments abroad. As a result of the price conversion, there is a possibility of a slight difference in the amount compared to the original price displayed on our website.
Complaint and return conditions
The hotel reserves the right to change the reservation or the way of providing services at any time if circumstances arise that are beyond our control, that cannot be predicted, avoided or postponed. The confirmed accommodation unit can be replaced by an accommodation unit of the same or higher category while maintaining the same price that was valid at the time of confirmation of the reservation and timely informing the guest about the change. In cases where it is not possible to find alternative accommodation, and the reservation has been paid in advance, the Hotel reserves the right to cancel the reservation and refund the entire amount paid. The guest can change an already defined reservation in accordance with the conditions of cancellation of the reservation that are shown to the guest during the reservation process and delivered to the guest with the reservation confirmation. The request to change the reservation is submitted online or in writing (by e-mail or mail). Immediately after determining the exact amount to be returned to the guest, payment will be made at the sender’s expense exclusively to the debit/credit card from which the reservation was made.
Currency conversion statement
All payments will be made in EUR. The amount for which your debit/credit card will be charged is obtained by converting the price into EUR according to the valid exchange rate list of the Croatian National Bank.
When charging with your debit/credit card, the same amount is converted from EUR to your local currency according to the rules that apply to payments abroad. As a result of the price conversion, there is a possibility of a slight difference in the amount compared to the original price displayed on our website.
Law and dispute resolution
All disputes will be resolved amicably with the application of Croatian law. Disputes within the European Union related to online shopping can be resolved through the ORS platform at the following link: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage.
In case of failure to reach an agreement, all disputes will be resolved before the competent court in Zagreb, applying Croatian law.
Jurisdiction of the court
If the customer is not satisfied with the resolution of the complaint procedure by www.jelsaresort.hr, he has the right to court arbitration. For such a case, the jurisdiction of the court in Split is contracted.

The service user/guest undertakes not to duplicate and/or publish any material subject to copyright or other intellectual property rights without the express permission of the holder of those rights.
